Terms & Conditions

Before using the website, you must read these guidelines stated in the Terms and Conditions. These terms and conditions apply to all users, visitors, and others who wish to use our service.

Contracts and Purchases

Dogs.lk will collect the breeder’s name, location, address, and age of the dog.
Dogs.lk will also get the sex, breed, color, and identification marks if any, at the time of the sale.
The breeder must inform if the worming treatments and the inoculations are done for the dog at the time of sale.
The breeder must have the veterinary record of any medications or treatment received by the dog.
While the sale is on, the breeder must prove that the dog has no illness or disease.
The breeder must make aware that the dog does not have any hereditary or congenital condition, which might affect the health of the dog during the sale or in the future.
Also, all the medical information required by the dog must be said orally for the purchaser by the breeder.
A breeder shall not sell any dog that is ill, diseased or a condition that requires nonselective surgical procedures or hospitalizations.
Dogs.lk is not responsible for any illness, deaths, or condition resulting from maltreatment or sustained injury or illness or neglect or contracted condition that is after delivery to the purchaser.
Dogs.lk is not responsible for any questions that arise due to not carrying out required treatments for the dog as said orally by the breeder to the purchaser.
Dogs.lk is not liable for the death of a dog and the issues arising thereafter like the purchase price refund, replacement dog of your choice, and reimbursement of veterinary fees.
No refund will be issued even if the payments are paid for the violation of the rules. No refunds will be given if the profile is suspended due to continuous reports.
The prices mentioned in dogs.lk are subject to changes and prices are conditional.
The ads will be rejected if non related items to dogs are posted.
The ads will be rejected if title, description and images do not match.

These terms and conditions do not limit the remedies and rights available for the consumers under the Sri Lankan laws, and the seller and the purchaser can enter into any additional terms and conditions.

Content

You can post, store, link, share, and otherwise make available certain information, graphics, text, videos, or other material (“Content”).You are responsible for Content that you post on or through our Service, including its reliability, legality, and appropriateness.
You warrant and represent that: (i)Content posted should not infringe the rights of any person, the rights of any entity, publicity rights or copyrights to the contract, privacy, and rights of any person. (ii)Material uploaded does not infringe the rights of any individual, any entity's rights, marketing rights or copyrights to the document, privacy, and privileges of any party.
Make sure that you retain the rights to all and any of you content that you submit, display, or post on or through our service and that you are responsible for protecting the rights. We will take no responsibility and assume no liability for the content that you or any other third party posts on or through our service. And posting the content with our service grants us the license and the right to modify, use, publicly reproduce, display, perform, and distribute those contents on and through our service. The license includes our rights to make content available for other users of the service, who can also use the content subject to the terms.
Dogs.lk is not obliged but has the right to monitor and edit all content provided by the users. And it is declared that the content found on or through our service is a property of Dogs.lk. You may not modify, reuse, distribute, download, transmit, download, copy, repost, or use the said content, whether in part or whole, for commercial purposes and or for personal gain without advance written permission from us.

Prohibited Uses

You may not use the service:

Infringing international or national legislation.
To seek to impersonate a Client, another consumer, a client employee, or some other organization or individual.
To ensure that any promotional or advertisement content, including any chain letter, junk mail, spam, or any other similar request, is sent or transmitted.
To engage in any other behavior, which restricts or inhibits any person's use or enjoyment of the Service, or which, as decided by us, may injure or offend users of the Business or Service, or expose them to liability.
We will suspend the Profile if we receive report about the user for more than 5 times.

Additionally, you agree not to:

Using Service in any way that could disable, overburden, harm or impair Service or interfere with the use of Service by any other user, including their ability to participate in real-time operation through Service.
Use any spider, robot, or other tools that are automated, processes, or means to access the service for any particular reason, which includes copying and monitoring the service material.
Try to use any of the manual processes to monitor or copy any of the materials without our concern Use any manual process to monitor or copy any of the material on the Service without our prior written consent or for any other unauthorized purposes.
Use any tool, program, or routine interfering with the proper functioning of the Service.
Introduce any malicious or technically dangerous content like viruses, worms, Trojan horses, logic bombs.
Gain control over any unauthorized entry, damage, and intrusion, interruption to any part of the service, servers associated with the service, or any device or database linked to the service.
Attack Server by a denial of service attack or a distributed denial-of-service attack.
Take any action that may damage or distort the rating of the Company
Otherwise, try to mess with the proper operation of the Company.

Analytics

3rd party service providers are used to monitor and analyze service use.

Limitation of liability and warranty disclaimer

The website is provided based on ‘as is’ and ‘as available’ basis. You agree that using this site is at your sole risk. ‘Dogs.lk’ disclaims all warranties implied or expressed including but not limited to MERCHANT WARRANTS and FITNESS for a given purpose. Dogs.lk assumes that the website, the servers and any emails sent from the severs are not free from any harmful components, or viruses. Dogs.lk is not liable for any damage of the site arising from the use of the site, which includes and is not limited to indirect, direct, punitive, incidental, and consequential damages. Due to certain laws the above said may not apply and you may have additional rights.

AD Descriptions

. Dogs.lk strive to be as accurate as possible. However we do not warrant that the site content or the ad descriptions are accurate, reliable, complete, error free or current.

Loss Risk

We suggest you refrain making payments to anyone without verifying the service/product as you expected. Do not involve with buyers or sellers regarding any transactions. Dogs.lk is not responsible for any transactions done without the buyer and the seller. ( we put blame on us clause)

PAID services

All the payments done online are irreversible and non-refundable.

Publication Rules

Not to post images copied from internet
Not to post images with water mark, pornography, logo text or logos.
Not to post contents for meat, farming, and gambling.
Products that are illegal, to import, export, sale or legal obligations applicable.
Not to use inappropriate language in the ads.
Animals Not permitted as domestic
Not to use products or services that bring legal issues.

Accounts

You guarantee us that you are at least 18 years of age and that the information provided is complete, accurate, and current. The confidentiality of the account along with password which includes and or not limited to the computer or account must be safe.
You are responsible for whatever activity that happens with your account and password whether it is with us or with any 3rd party service. Any breach of activity or security or unauthorized use of the account must be immediately notified.
We have the right to terminate accounts, remove/edit content, cancel orders, and or refuse service in our sole discretion. Never use a username, which is vulgar, obscene, or offensive.

Intellectual Property

The original content and the services, functionality, and features are the exclusive property of the Dogs.lk. You may not use the trademarks used in the website without any written consent from Dogs.lk

Governing Law

The laws of Sri Lanka are applicable, and the service is governed and construed accordingly by the Laws of Sri Lanka.

Amendments to Terms

We can, at any time, amend the Terms by posting the amended terms on this site. This is your duty to regularly review these Definitions.
Your continuing use of the site since publishing the new terms means that you recognize and adhere to the changes. You are supposed to visit this page periodically so that you are aware of any updates that are binding on you.
By continuing to use our Service after any revision has become effective, you agree to be bound by the revised terms.

ELECTRONIC COMMUNICATION

The emails sent to and from dogs.lk means that there is an electronic communication with dogs.lk. At the time of posting the ad, we collect your email address. We communicate with you through the email address and notifications on the dashboard. Hence, you agree that all the notices, agreements, communications, and disclosures that happen electronically are all satisfying the legal requirements as if those communications are in writing.

DISPUTES

Any disputes relating the visits to dogs.lk and purchases of products through dogs.lk are subject to arbitration laws in Sri Lanka. The extent to which you have violated or threatened to violate intellectual property rights of dogs.lk depends on the fact that dogs.lk may find injunctive or any relief from the Sri Lankan court.
